Can I avoid any criminal record from a bad check?

I have a preliminary hearing about a bad check to my former landlord. The court paperwork shows it as being a felony. My landlord and I have come to an agreement about paying the money back. When he called the district court to try and stop proceedings, they told him they couldn’t and we both had to show up to the hearing. They also said something about the charge being reduced to a summary offense. I want to avoid any charges on my record. Is that possible, or am I definitely getting a charge over this. This check was written with the understanding that it wasn’t to be cashed until I had received the funds to make it good. My business failed at the time and I wasn’t able to complete the sale that would have generated the funds. It wasn’t like I wrote him the check and just said screw it, we had an agreement that he wouldn’t try to cash it until I said it was ok. Stupid I know, but I trusted he wouldn’t.

Can i beat a false identification to law enforcement charge?

the state police showed up to my house looking for a previous tenant. they knew my first name was john but i lied to them about my last name. they were not looking for me but a guy named cory. i invited them into my house and tried to help them. i had warrant for failure to pay fines. they ran the name i gave them and it didnt show up on a computer. i finally gave them my real name and tey said if i helped them they would not file charges. well they filed charges. is this a serious offense and if it is will i go to jail? i have a bad check and theft by deception from 1994 and 2 dui 8 years ago.

How do you recommend someone that is currently serving a Mandatory Minimum Sentence, but the state of PA currently changed the rules for to proceed?

PA currently changed the Mandatory Minimum Sentence Law. I have a family member serving that sentence. He has already served 7 years, and has an additional 7 years. He is serving more time that people that have done worse crimes. What do you recommend since the law has changed in PA…. What should we do?

Probable cause in a DUI case.

My cousin got a DUI in PA. About a month later the arresting officer resigns after an investigation. It turns out the cop was doing illegal license searches. He looked up 8,000 driver’s licenses for information over a three year period. Could my cousin possibly have his case thrown out if he challenges the officer’s probable cause? I know in order to to that he will need a lawyer, but I want to know if there is an actual defence here to have the case thrown out. Almost all first time offenders in PA get ARD with or without a lawyer so, it would not make sense for him to hire a private attorney if he cannot use the officer’s illegal activity to challenge the reasons for the traffic stop in the first place. PCRA grounds change of information

Imy fiance took a plea in PA for person not to posess firearm because of a felony conviction in MD. when researching I called MD and his case was never finalized 6 years ago. his case in MD is now before a judge there where there is a good possibility that a PBJ will be done. under MD law PBJ is not a conviction. would this have any affect on the plea in PA? could I file a PCRA based on that? THe lawyer we had during our PA case was under investigation and is now in prison himself. We had asked him numerous times to call MD and get that case information as we knew something was not right as he was told it was not a felony in MD. had I never called his case would still of never gone before a judge. I am hopeful for a good outcome but wondering if it wil have an effect here in PA. it’s a felony here in PA but according to MD lawyer it would be a PBJ there and therefor not an actual conviction.

Would I be committing a crime in this situation?

I go to a fast food restaurant and go through the drive-thru, and when I’m handed my bag of food I set it in the passenger seat and go home. Once I get home I look in the bag and instead of food there’s a couple thousand dollars. The employee accidentally handed me the bag that was supposed to go to the bank. The manger quickly figures out that it was me who got the bag because I paid with a debit card and my food was still there. They call my house and I refuse to give it back, because I figure that I was given it so I can keep it if I want. Am I committing a crime?

Hello, I have a question about a legal scenario. A friend of mine is turning himself in for stealing bank account funds. The money was stolen via PayPal, now in order to transfer the money to his PayPal account he made an account in the cardholders sons name, and then transferred it to his account. He only did this to not have a conflict of names with the credit card company preventing the transfers otherwise he would have put it on his own. The money was transferred from the credit card on the created account to his own which he then used to purchase items. The total amount is roughly 5000 dollars. Now he is a first time offender, an exemplary student in the top 10% of his class, and only 17. What would be the most likely punishment in this scenario? And would the creation of the account constitute identity theft?
