Cliff Bidlingmaier And Co-Counsel Robin Lord File Appeal After Clients’ Claims Are Dismissed

Cliff Bidlingmaier is co-counsel on a case where Plaintiffs had certain claims dismissed by the Superior Court Judge who believed that the same-sex relationship and ultimately the relationship maintained between the non-biological mother and the child didn’t rise to the level of being ‘family.’

In New Jersey, a family member can recover for the negligent and/or intentional infliction of emotional distress that arises out of the observing of the death of a loved one. This doctrine was set out in the seminal case of Portee v. Jafee. In the Moreland case, the trial judge found that although the minor 2 1/2-year-old child referred to her mother’s partner as ‘Mom’ this did not meet the level of family. (more…)
